Spanish marketplace suspension: a seller's checklist

TL;DRA Spanish marketplace suspension on Amazon ES means your listings have been removed or your account restricted on the Amazon.es platform, typically because Amazon has cited a policy breach, a product-safety concern, or a compliance failure under EU law. The suspension is not automatically final. European sellers hold procedural rights under the Platform-to-Business (P2B) Regulation, the Digital Services Act (DSA), and Amazon's own internal complaint system – rights that a structured response can use to reopen the account or restore specific listings.

This checklist organizes the response into phases. Work through each phase in order. The earlier you act, and the more precisely you identify what Amazon actually cited, the more options stay open.

Phase 1: Read the notice – what did Amazon actually cite?

The single most important task in the first 24 to 48 hours is identifying the specific grounds Amazon used to suspend the account or remove the listings. Many sellers skip this step and jump straight to drafting a response, which is why a significant share of first appeals fail.

Under the P2B Regulation, Amazon is legally required to provide a statement of reasons for any restriction, suspension, or termination of a seller's access to the platform. That statement must explain the facts and circumstances on which the decision is based. If the notice you received is vague or generic, that omission is itself a compliance point you can press.

  • Save the original suspension or delisting notice in full – do not rely on a screenshot alone. Download the complete Seller Central notification, including any case ID references, and store it outside the platform.
  • Identify whether the action covers the whole account or specific ASINs. A full account suspension and a listing removal follow different procedural paths.
  • Identify the category Amazon used: policy violation, product safety, counterfeit or authenticity complaint, intellectual-property complaint, identity or verification failure, or a related-account flag.
  • Check whether a General Product Safety Regulation (GPSR) or Extended Producer Responsibility (EPR) issue is mentioned. These carry separate documentation requirements that a generic Plan of Action will not satisfy.
  • Note the exact date and time of the notice. The clock on certain appeal windows starts from this point.
  • Check whether the notice contains a deadline to respond. Amazon ES notices sometimes include one; if it does, that date controls your immediate timeline.

Why this matters: A mismatch between the grounds Amazon cited and the grounds you address in your appeal is the leading cause of rejection on first filing. In matters we handle, the notice frequently contains a precise technical citation – a GPSR documentation deficiency, a listing attribute violation, or a specific policy clause – that the seller's initial response ignored entirely.

Phase 2: Gather your documentation before you file anything

Filing an appeal before your evidence is in order is the second most common mistake. Amazon ES, like other EU marketplace surfaces, expects sellers to attach supporting documents – not simply to assert compliance.

Build a document folder before drafting anything. The contents depend on the suspension type, but the core set for most Amazon ES matters is:

  • Proof of entity identity: your VAT number, business registration certificate (in Spain: the certificado de alta en el censo de empresarios or equivalent), and identity documents for the account's beneficial owner.
  • Supplier chain documentation: purchase invoices from authorized distributors or manufacturers, including the supplier's own registration details. Invoices must show the product identifiers (EAN/GTIN) and quantities.
  • GPSR compliance documents: if the suspension touches a product-safety issue, you will need EU Declaration of Conformity, CE marking records, test reports from an accredited body, and the contact details of your EU Responsible Person (if you are a non-EU manufacturer or importer). Our guide on the GPSR Responsible Person requirement covers the specific obligations this rule creates.
  • EPR registration evidence: if the products fall under EPR categories (packaging, batteries, electronics, textiles), proof of registration with the Spanish producer responsibility organization or the relevant national registry.
  • Brand authorization or resale right evidence: authorization letters, distribution agreements, or trademark license documentation if the complaint touches authenticity or IP.
  • Correspondence history: any prior communications with Amazon about the ASIN or account, including previous appeals and their outcomes.

What if some documents are missing? Note the gap explicitly rather than ignoring it. Attempting to file without a key document, and not acknowledging it, signals to Amazon's review team that the root cause has not been addressed. If a document can be obtained within a realistic timeframe, say so and provide a dated commitment. If it cannot be obtained – for example, because the supplier is no longer traceable – the strategy shifts to demonstrating alternative compliance evidence.

Is every suspension really about documentation gaps? Not always. Linked-account flags, verification failures, and automated algorithm triggers require a different evidence set – ownership records, IP address history, or a detailed timeline reconstructing the account's commercial history.

For broader background on how the EU regulatory regime shapes every stage of this process, the EU marketplace regulation complete guide for sellers covers the P2B, DSA, and DMA obligations that apply across Amazon's EU surfaces.

Phase 3: Assess the suspension category and choose the right procedural path

Not every Amazon ES suspension uses the same appeal channel, and picking the wrong one delays resolution and may narrow your remaining options.

Amazon ES operates multiple internal channels: the Appeal button in Account Health, the case system in Seller Central, and, for product delistings, ASIN-level reinstatement requests. Over and above these internal routes, EU law creates additional paths that sellers frequently overlook.

  • Internal complaint mechanism (DSA/P2B route): Under the P2B Regulation, Amazon is required to maintain an internal complaint-handling system for sellers who dispute a restriction decision. This system is separate from the standard appeal flow. A formally submitted internal complaint creates a documented record of your challenge, and Amazon must provide a reasoned response. In matters we handle, initiating this route alongside the standard appeal strengthens the seller's position and preserves options for escalation.
  • Account Health appeal (Seller Central): The standard route for policy and performance deactivations. Use this for non-GPSR account-level suspensions where your documentation is complete. Draft a root-cause Plan of Action (POA) addressing: what happened, what corrective steps you have taken, and what you will do to prevent recurrence. Generic POAs are rejected; specificity on the Amazon ES surface means naming the exact ASIN, the exact policy cited, and the exact corrective action taken with supporting evidence attached.
  • ASIN-level reinstatement: For listing removals that do not affect the whole account. The appeal is filed against the specific ASIN. Attach the relevant compliance documentation for that product directly.
  • Escalation to Amazon's Trust & Safety or seller support management: Used after a first rejection, when the automated review cycle has stalled, or when the stated reason is factually incorrect. Document escalation attempts; they become relevant if the matter moves to formal complaint or mediation.
  • Out-of-court dispute settlement / mediation: Under the P2B Regulation, sellers on EU marketplaces have the right to access out-of-court dispute settlement by mediators included on the P2B Regulation's list. This is a binding procedural right, not a courtesy. It is relevant when internal routes have been exhausted and the seller has a documented, substantiated case.

If the suspension relates to a product-safety delisting rather than an account action, the procedural analysis changes. Our separate resource on product safety delisting in the EU details how those cases differ from standard account suspensions and what evidence they require.

Phase 4: Draft and submit your response

A well-drafted first filing is worth spending time on. Amazon's review teams process a large volume of appeals, and an unclear or incomplete response typically generates an auto-rejection or a boilerplate request for further information – both of which extend your downtime.

  • Open with a clear statement of what happened, in plain commercial terms. Avoid legal jargon in the appeal itself. The reviewer needs to understand the situation in the first paragraph.
  • Address every point in the original notice. If Amazon cited three issues, your POA addresses all three, in the same order, with evidence for each.
  • Be specific about corrective action. "I will comply with Amazon's policies going forward" is not a corrective action. A corrective action is: "I have removed the affected ASIN from active inventory, obtained a new Declaration of Conformity dated [date] from the manufacturer, and updated the product listing to reflect the correct EU Responsible Person contact as required by Article 16 of the GPSR."
  • Attach evidence in the formats Amazon ES accepts. Large PDF bundles without labeling slow the review. Organize attachments by the POA point they support, with a brief attachment index at the start of the document.
  • Keep the tone factual and professional. Expressions of frustration, accusations of error, or threats of legal action in the appeal itself rarely help and sometimes trigger escalation in the wrong direction.
  • Submit the appeal and create a case record immediately after. Note the submission date, time, and the case number assigned. You will need this for tracking and escalation if the response is delayed.

The steps above describe the standard path. Your situation turns on the exact wording of the Amazon notice, the account history, and the specific EU compliance requirements for the products involved – which is what we review first. Phase 5: After filing – track, escalate, and protect the account

Filing is not the end of the process. Many Amazon ES reinstatement matters require one or more follow-up steps after the initial submission.

  • Track the response window: Amazon ES standard response times on appeals vary. If you have not received a substantive response within what is a reasonable window for the appeal type, follow up via the case system – not by filing a duplicate appeal, which can reset the clock and create conflicting case records.
  • Evaluate the rejection before re-filing: If the first appeal is rejected, read the rejection carefully. Amazon sometimes provides additional specificity in the rejection that was absent from the original notice. This additional detail resets your analysis: the rejection's stated reason may differ from the original suspension's stated reason, and the refiling must address what the rejection actually says.
  • Escalate through the DSA internal complaint mechanism: If internal appeal routes have been exhausted without a compliant response, and your matter has merit, the formal P2B internal complaint and the DSA statement-of-reasons challenge are available. We regularly see situations where the formal invocation of these EU-law rights accelerates a review that had stalled in the standard Seller Central queue.
  • Protect remaining inventory and cash: While the appeal is pending, avoid making changes to the suspended account that could trigger further automated review. Do not open a new account to replace the suspended one – this is a linked-account violation and will compound the problem. If FBA inventory is held, monitor removal order timelines and keep disposal and return options in view.
  • Document everything: Keep a running log of every submission, every response, every escalation, and every outcome. If the matter moves to out-of-court mediation or legal proceedings, this record is your evidence base.

A first appeal or internal complaint that comes back rejected is not necessarily the end of the road. A second review by an attorney who has not been involved in the initial filing can identify the specific gap that caused the rejection and whether anything is still open. Phase 6: Know your EU legal rights as a seller

The prevailing myth is that EU sellers have no leverage once a platform suspends them. That is not the law. The P2B Regulation, the DSA, and the DMA together create a set of enforceable rights that Amazon, as a large online platform and designated Very Large Online Platform under the DSA, must observe.

Understanding these rights does not require a legal degree. It requires knowing which ones apply to your situation.

  • Right to a statement of reasons (P2B Regulation): Amazon must explain the factual and legal basis for any restriction. A vague or conclusory notice may not satisfy this requirement. If the statement of reasons is inadequate, you can formally request a compliant one.
  • Right to 30 days' prior notice (P2B Regulation): For terminations (as distinct from urgent suspensions), Amazon must provide at least 30 days' advance notice with reasoning. Urgent suspensions are permitted where Amazon can demonstrate a serious reason. Whether the cited reason meets the "serious reason" threshold is a question worth examining in any Amazon ES suspension.
  • Right to internal complaint handling (P2B Regulation): Sellers have the right to submit a complaint through Amazon's internal complaint-handling system and to receive a substantive, individualized response. This is a distinct legal obligation, separate from the standard appeal flow.
  • Right to out-of-court dispute settlement (P2B Regulation): Sellers can refer disputes to P2B-listed mediators. This is a right the platform cannot contractually override for EU sellers.
  • DSA transparency obligations (DSA): Under the DSA, Amazon as a VLOP must provide clear reasons for content removal or account restriction. These obligations supplement the P2B rights and can be invoked in parallel.
  • DMA considerations (DMA): For sellers who believe Amazon's suspension practice reflects a systemic abuse of gatekeeper power over a core platform service, the Digital Markets Act creates regulatory channels at the European Commission level – a longer route, but relevant for structural or discriminatory suspension patterns.

In matters we handle on Amazon ES, the explicit invocation of P2B rights in a well-documented internal complaint frequently produces a more substantive response from Amazon than the standard appeal alone. The platform's EU compliance obligations create a real pressure point that sellers should use.

Frequently asked questions about Spanish marketplace suspension

How long does resolving Spanish marketplace suspension usually take on Amazon ES?

Resolution timelines vary significantly depending on the suspension category, the completeness of the seller's documentation, and whether escalation is needed. A listing-level reinstatement where the documentation is already in order can move in days. An account-level suspension involving GPSR compliance gaps, identity verification issues, or a formal P2B complaint process typically takes several weeks. In matters where a first appeal is rejected and a second filing or formal complaint is required, the timeline extends further. Acting quickly on a complete, well-evidenced response is the most reliable way to keep the timeline short.

What are the main risks if I handle Spanish marketplace suspension alone?

The primary risk is filing an appeal that addresses the wrong issue – responding to what you think the suspension is about rather than what Amazon's notice actually cited. A mismatched appeal typically produces a rejection, and each rejection narrows the options for the filing that follows. A second risk is missing the EU legal rights available to you: the P2B internal complaint mechanism and the DSA statement-of-reasons challenge are frequently overlooked by sellers managing the process alone, yet these are often the routes that break a stalled review. A third risk is making changes to the account – such as opening a second account to replace the suspended one – that compound the original problem.

Do I need a lawyer for Spanish marketplace suspension?

Not every Amazon ES suspension requires an attorney. A listing-level removal with a clear documentation gap that the seller can resolve quickly and completely is often manageable without legal help. The situations where attorney-led handling adds the most value are: full account suspensions where the stated reason is unclear or contested; matters involving GPSR or product-safety obligations that require navigating EU-level compliance documentation; suspensions that have already been rejected once; and any matter where the seller wants to invoke P2B or DSA rights formally. Attorney-led handling also matters for preserving a clean documented record if the matter later moves to mediation or legal proceedings.
