A suspension on Amazon DE is not a single type of event. That distinction matters enormously, because the procedural path, the timeline, and the available levers are different depending on which category applies to your account.

In broad terms, suspensions on Amazon DE fall into three overlapping categories. The first is a performance-based deactivation triggered by Account Health metrics – late shipment rates, order defect rates, or return-related issues. This category is governed primarily by the Amazon Business Solutions Agreement (BSA) and Amazon's internal policies. The second is a policy-based deactivation triggered by compliance concerns – product safety, restricted products, identity verification (KYC), counterfeit or inauthentic complaints, or intellectual property complaints. The third, and the one most specific to German and EU operations, is a deactivation tied to EU regulatory compliance requirements: product documentation under the General Product Safety Regulation (GPSR), Extended Producer Responsibility (EPR) registration, CE marking obligations, or requirements that apply specifically to Amazon as a Very Large Online Platform (VLOP) under the DSA.

In matters we handle on Amazon DE, a disproportionate number of suspensions cite multiple grounds at once. The notice says "account review" or "selling privileges removed" without clearly separating the regulatory issue from the performance issue. That ambiguity is not accidental, and it is the first thing that needs to be untangled.

An EU marketplace suspension under the DSA or P2B Regulation carries specific procedural obligations for the platform. Under the P2B Regulation, Amazon is required to give business sellers at least 30 days' notice before terminating a contract except in specified circumstances, including illegal content or safety risk. The DSA requires Amazon, as a VLOP, to provide a statement of reasons for any content restriction or account suspension. These are not optional courtesies – they are rights you can point to directly in your complaint and, where necessary, in formal dispute resolution.

Step 1: Read the notice for what it actually says – and what it does not

The first and most consequential step is a careful read of every notice and email you have received. Do not respond to the first email before completing this read.

Print or export every notification in the suspension chain, in order. For each notice, identify: (a) the stated reason, exactly as written; (b) the specific policy section or regulation cited, if any; (c) whether Amazon has provided a statement of reasons in the DSA sense – an explanation of the facts, the rule applied, and why your account or listing was found to breach it; and (d) the response mechanism offered, if any – a button to appeal, a link to a verification flow, or simply a reference to Seller Central's Account Health page.

Pay close attention to what is absent. A notice that says only "your account has been deactivated for violating our policies" without specifying which policies, which ASINs, and what conduct is a notice that may itself be non-compliant with the DSA's statement-of-reasons requirement. That absence is leverage, not a dead end.

Where the suspension is about a specific ASIN rather than the whole account, check whether the affected listing is subject to a specific EU compliance requirement – GPSR documentation, EPR producer registration, or a CE marking obligation – and whether you actually have that documentation in your Seller Central account. In our experience, the most common reason a GPSR-related suspension cannot be resolved quickly is that the seller does not know what documentation Amazon expects, or has uploaded the wrong version of it.

Step 2: Identify which regulatory regime applies

Different rules govern what Amazon must do, and what you can do, depending on which regime triggered the suspension. Getting this mapping right before drafting any response is the difference between an effective submission and one that addresses the wrong question.

The P2B Regulation (EU 2019/1150) applies to all business sellers on Amazon DE. It requires Amazon to provide plain and intelligible terms, explain any differentiated treatment, give advance notice before termination in most cases, and give access to at least two qualified independent mediators for dispute resolution. If Amazon terminated or restricted your account without the required notice period and without invoking one of the permitted exceptions, that breach is itself an argument in your complaint.

The DSA applies to Amazon's obligations as a VLOP. It requires a statement of reasons for each restriction, access to an internal complaint mechanism, access to an out-of-court dispute settlement body, and periodic transparency reporting. If your notice lacks a genuine statement of reasons, the internal complaint to Amazon should say so explicitly, citing the DSA obligation.

The DMA (Digital Markets Act) designates Amazon as a gatekeeper in the online intermediation services market. The DMA's obligations are more structural – they govern how Amazon ranks products, what data it shares, and how it treats third-party sellers relative to its own retail arm. A DMA argument is not typically the primary tool in a single-account suspension, but if the suspension pattern suggests systematic unfavorable treatment, the DMA provides a regulatory context and, eventually, an enforcement avenue through the European Commission.

German national law adds a further layer. Germany's Act Against Restraints of Competition (GWB), as amended to strengthen digital-market enforcement, gives the Bundeskartellamt authority over gatekeepers designated under the German competition statute – Amazon has been subject to Bundeskartellamt proceedings under §19a GWB, making Germany one of the most active national jurisdictions for platform enforcement in Europe. Step 3: Use the internal complaint mechanism before escalating

The DSA requires Amazon to operate an internal complaint-handling system for sellers. Using it is not just a formality – it is a required step that creates a record before any external escalation becomes available.

The internal complaint must be specific. Generic language ("I believe my account was wrongly suspended") does not build the record you will need. A well-constructed internal complaint does the following: it identifies the specific notice or restriction at issue; it states which regulatory obligation Amazon has not met (statement of reasons, notice period, etc.); it sets out the seller's position on the substance of the alleged breach; and it requests a specific remedy – reinstatement, partial reinstatement by ASIN, or at minimum a compliant statement of reasons.

We regularly see sellers submit what they think is an appeal but is actually a general inquiry or a follow-up to an Account Health notification. Those submissions go to different queues and are processed differently. The internal complaint under the DSA should be submitted through the channel Amazon designates for that purpose in its seller-facing documentation, and it should be labeled as such.

Keep copies of everything. The complaint, the timestamp, and any acknowledgment or response from Amazon are all part of the record if you need to move to out-of-court dispute resolution or a regulatory complaint later.

Step 4: Build your substantive case alongside the procedural case

Procedural rights get you into the room. The substantive case decides what happens there.

The substantive case depends on the type of suspension. For a GPSR-related suspension, the case is documentation: product safety reports, technical files, declarations of conformity, EU Responsible Person information, and the traceability records the regulation requires. For an EPR suspension, it is registration evidence – proof of producer registration in the relevant German EPR scheme. For a counterfeit complaint, it is authorization evidence – purchase invoices, brand authorization letters, or supply-chain records. For a performance suspension, it is a root-cause analysis and a corrective-action plan.

For Amazon DE specifically, sellers should be aware that German consumer protection enforcement is active and that product-safety complaints from German market surveillance authorities can trigger a suspension from the regulatory side, not just the Amazon-policy side. If the notice references a market surveillance authority or an enforcement action, the case becomes a multi-front matter and the response strategy needs to address both fronts.

A micro-case from our practice illustrates the layered nature of these matters. An electronics accessories seller on Amazon DE (winter 2025) received a deactivation notice that cited "product safety" without further detail. The seller had CE marking documentation and assumed the issue was a paperwork formality. On closer review, the actual problem was that the ASIN lacked an EU Responsible Person designation as required under the GPSR – a designation that is separate from CE marking. Step 5: Know when to escalate and what escalation actually means

The P2B Regulation requires Amazon to give sellers access to at least two qualified independent mediators for out-of-court dispute resolution. This is a rights-based mechanism, not a favor Amazon grants. The DSA similarly requires access to out-of-court dispute settlement bodies certified under the DSA for non-business sellers and, for business sellers on a VLOP, through the P2B mediation route.

Mediation under P2B is not arbitration. It is a structured negotiation facilitated by a neutral. It is not binding on Amazon in the same way that arbitration would be under a different contractual regime. Its value is partly in the record it creates and partly in the cost-versus-pressure dynamic: Amazon has an incentive to resolve P2B mediation cases rather than have them become regulatory complaint files.

Regulatory complaints to the Bundeskartellamt or to a national DSA coordinator are a separate track. They are slower and the outcome is not directly "restore my account." Their value is in the systemic pressure they create, particularly for sellers facing patterns of treatment rather than a single one-off suspension. Where German marketplace suspension handling goes wrong

Most failures in handling an Amazon DE suspension happen at one of four points. Understanding them is as important as understanding the steps themselves.

The first failure point is responding without reading. Sellers click the appeal button or send the first email before they have fully mapped the suspension type, the notice, and the documentation required. A second illustrative matter: a personal care products brand selling on Amazon DE (summer 2026) had received successive internal complaint rejections over several months. The seller had been filing appeals through the Account Health dashboard, treating each response as a policy appeal rather than a DSA internal complaint. The myth that EU sellers have no leverage once a platform suspends them is exactly that – a myth. The DSA, the P2B Regulation, and the GWB together create a set of procedural and substantive rights that are real and enforceable. The question is not whether leverage exists, but how to apply the right lever to your specific suspension type, at the right stage, in the right sequence.

If a first internal complaint has already come back rejected, a careful read of Amazon's response and the original notice chain can identify the specific gap – whether it is a procedural failure on Amazon's side, a documentation deficiency on the seller's side, or a mismatch between what Amazon asked for and what was filed.
