TL;DRAmazon holds Very Large Online Platform (VLOP) designation under the Digital Services Act (DSA), which means sellers on Amazon FR and across EU surfaces operate under a distinct regulatory regime – one that grants enforceable procedural rights no BSA clause can strip away. When Amazon restricts, suspends, or delists a seller under that regime, the DSA and the Platform-to-Business (P2B) Regulation require a statement of reasons, access to an internal complaint system, and, where applicable, out-of-court redress. A suspension under EU rules is not final. The path through it is procedural, and the seller who moves through each phase methodically has leverage that most never use.

This checklist organizes that path into phases. Each phase carries the checks that matter most at that moment, the reason each one matters commercially, and the decision points where the wrong move narrows options later. Phase 1: Understand what "VLOP" status actually means for your Amazon FR account

  • Confirm the notice you received is from Amazon FR specifically, or from Amazon's pan-EU systems acting on EU-designated grounds. The surface matters because procedural rights attach to EU-based sales activity.
  • Identify whether the restriction is a full account suspension, a listing deactivation, a ranking suppression, or a withholding of disbursements. Each triggers a different set of procedural rights under the DSA and P2B Regulation.
  • Check whether Amazon provided a statement of reasons. Under Article 17 of the P2B Regulation and the DSA's related transparency obligations, a statement of reasons is mandatory before or contemporaneously with a suspension – not an optional courtesy. Its absence is itself a procedural violation you can raise.
  • Note the date and time the notice was delivered and the date your listings or funds became restricted. That sequence matters for any internal complaint you later file.

Why this matters commercially: The DSA's statement-of-reasons requirement is not procedural decoration. Phase 2: Read the statement of reasons – and spot what it does not say

The statement of reasons Amazon provides is both the basis of the restriction and the roadmap for challenging it – but only if you read it as a legal document, not a policy notification.

  • Identify what the notice does not say. Did Amazon state what evidence it relied on? Did it identify the specific product or listing? Did it give a specific policy section? Gaps here are grounds for internal complaint.
  • If the statement is absent or clearly inadequate, document that fact explicitly before taking any other step. Do not file a response to the substance of a charge that was never properly stated – that can be treated as a waiver of the procedural objection.
  • Cross-reference the stated ground against the P2B Regulation's Article 4 requirements on termination. The regulation sets out minimum information that must accompany a restriction of a continuing commercial relationship. Amazon's notice must meet that standard.

Why this matters commercially: Sellers who respond immediately to the substance – explaining their sourcing, uploading certifications – without first testing the adequacy of the statement of reasons often foreclose the procedural route. On Amazon FR, as enforcement automation has tightened, statements of reasons have become more templated and less specific. That template language is frequently insufficient under the DSA. Spotting the gap is worth doing before you draft a single word of substantive response.

What are the realistic routes once you have read the notice?

Once you understand what was stated and what was not, three routes are available, and they are not mutually exclusive – they can be run in sequence or, in some cases, in parallel.

The first route is the internal complaint system. The DSA requires VLOP operators to maintain an accessible internal complaint-handling system for business users. Amazon's system must be easy to use and must result in a timely decision. A complaint filed correctly – citing the specific procedural obligation Amazon failed to meet – is not the same as a standard Seller Central appeal. It initiates a separate process with its own obligations on Amazon's side.

The second route is the out-of-court redress mechanism. P2B Regulation Article 12 requires that platforms commit to work with certified mediation bodies for disputes with business sellers. The third route is regulatory escalation. The European Commission also has direct supervisory jurisdiction over VLOPs in certain circumstances.

  • Decide the immediate priority: account restoration or funds recovery. Both can be pursued but require different first steps, and doing them in the wrong order can delay both.
  • Do not treat the internal complaint system as an informal escalation path. File it as a formal procedural document. State the obligation Amazon violated, the specific article or regulation you rely on, and the remedy you seek.
  • Assess whether the out-of-court route is faster for your situation. Where the restriction is based on a factual error and Amazon's internal process is unlikely to self-correct, mediation via a certified body can be quicker than waiting for a second internal decision.
  • If regulatory escalation is appropriate, understand that this route operates on a longer timeline and does not restore your account. It builds systemic pressure and may be relevant where the violation is part of a pattern across multiple sellers.

Phase 3: File the internal complaint – the right way

Filing an internal complaint under the DSA is a procedural act with legal consequences. A complaint that is vague, that mirrors a standard Seller Central appeal, or that focuses on commercial impact rather than regulatory obligation is unlikely to be treated as a DSA complaint at all – and may not restart the clock on Amazon's obligations.

  • Lead with the regulatory obligation: state explicitly that you are filing an internal complaint under the DSA and, where applicable, the P2B Regulation, and identify the specific obligation you allege Amazon has not met.
  • Attach the statement of reasons Amazon provided (or note its absence). Attach the timeline of events. Attach any evidence that the stated ground is factually incorrect or legally insufficient.
  • State the specific remedy sought: reinstatement of the account or listing, release of held funds, or both. Quantify the commercial impact in general terms – not a damages claim, but a description of the business consequence of continued restriction.
  • Note the date of filing. Amazon's internal complaint system must handle complaints in a timely manner under DSA obligations. If no decision comes within a reasonable period, that delay is itself a basis for escalation to out-of-court redress or to the relevant Digital Services Coordinator.
  • Keep a complete copy of everything filed, including the submission method and the confirmation of receipt.

Phase 4: Assess DMA gatekeeper obligations if your issue is structural

The Digital Markets Act (DMA) adds a second regulatory layer where the problem is not a one-off suspension but a structural feature of how Amazon operates – self-preferencing, data access asymmetry, or tying practices that disadvantage third-party sellers systematically.

Amazon has gatekeeper designation under the DMA for its core platform services. That designation creates specific obligations around how Amazon must treat third-party sellers relative to its own retail operations – on ranking, data access, and default settings.   • If you believe the restriction reflects Amazon systematically favouring its own products or data – not just a policy enforcement decision – document the pattern across ASINs and over time. Single data points are weak; patterns across listings and time periods are the evidence basis for a DMA complaint.
  • Understand that a DMA complaint to the European Commission does not restore your account directly. It contributes to systemic proceedings. The appropriate immediate route for account restoration remains the DSA/P2B internal complaint path.
  • Check whether the Bundeskartellamt or a national competition authority in your country of establishment has open proceedings relevant to your sector. National proceedings can move faster than Commission-level DMA enforcement and can reach interim measures.

Phase 5: Decide whether to escalate – and to what

Escalation has a cost. It takes time, the outcome is not guaranteed, and the wrong escalation in the wrong sequence can prejudice what remains available. The decision to escalate – and which route to take – is the most consequential judgment call in the whole process.

If a first appeal or internal complaint already came back rejected, a second read can find the specific reason it failed and what, if anything, is still open under the DSA, P2B, or DMA regimes.

Phase 6: Address the underlying compliance gap – and document it

Even where Amazon's procedure was defective, the underlying issue that triggered the restriction usually exists. Addressing it is not an admission that the restriction was valid – it is the practical step that removes the factual basis for continued restriction and, critically, prevents recurrence.

  • Identify what the underlying compliance gap actually was, separate from what Amazon's notice said. These are sometimes different. Doing only the procedural challenge without addressing the substance leaves the underlying issue open for a second restriction. Doing only the remediation without the procedural challenge concedes leverage you did not need to give away.
